That day, he posted a link on Parler that allowed users to access an episode of his podcast titled “Rebel Talk with Rufio.” On January 5, 2021, he wrote on Parler, “It is apparent now more than ever, that if you are a patriot, you will be targeted and they will come after you, funny thing is that they don’t realize is, is we are coming for them. 7. He was one of the Proud Boys members who went to the U.S. Capitol building in Washington, D.C., USA on January 6, 2021. That day, Donald Trump supporters breached the building while a joint session of Congress was certifying the vote of the Electoral College and affirming Joe Biden‘s victory in the 2020 presidential election. He was also seen marching with self-described Proud Boys organizer Joseph Biggs. _(b)
8. A Federal Bureau of Investigation special agent filed a criminal complaint against him, which was signed by U.S. Magistrate Judge Zia M. Faruqui on February 2, 2021. _(b)
9. On February 3, 2021, he was arrested. He made his initial appearance via Zoom before Chief Magistrate Judge Brian Tsuchida. Represented by Corey Endo, he was charged with obstructing an official proceeding, aiding and abetting injury to government property, disorderly conduct and knowingly and violently entering a restricted building for his participation in the U.S. Capitol riot on January 6, 2021. _(a)
