Derek Chauvin, 47, was a Minneapolis Police Department officer when he knelt on George Floyd‘s neck for about 9 minutes while Floyd was handcuffed and lying face down on the street in Minneapolis on May 25, 2020. Floyd died that day at age 46.

On April 13, 2021, Foy took to Facebook to share an illustration of a black man with the words “Martin Looter King.” On June 1, 2022, he took to Facebook to share a photo of Chauvin kneeling on Floyd’s neck with the words, “With gas hitting 4.89 and climbing, let’s all take a moment to appreciate better times.”

On June 5, 2023, Foy was sworn for duty as a Marion Police Department officer in the City Hall Council Chambers of Marion. He completed the necessary training at the Indiana Law Enforcement Academy in Plainfield, Hendricks County, Indiana, according to the department.

On June 6, 2023, Foy’s Facebook posts on April 13, 2021 and June 1, 2022 were brought to the attention of the Marion Police Department. After personally reviewing the posts, the department’s chief Angela Haley said the posts are racist.

“The posts are not keeping with the standards of the Marion Police Department,” Haley stated. “I do not condone this type of behavior and will not tolerate it.”

On June 7, 2023, the Marion Police Department fired Foy. He has yet to release a statement about his termination.
