Godfrey Hercules II, 29, and his partner Mariah Banks, 27, were arrested in Winter Haven, Polk County, Florida, United States on March 4, 2025 while they were with their daughter, 3. That day, he was observed with a firearm while in an altercation with Jesus Crespo Perez, 46, in the parking lot of Santiago’s Market in Winter Haven that day.
Perez is an employee of the store. Hercules left in a red Nissan Altima before Winter Haven Police Department officers arrived at the store at around 1:00 p.m.
Later that day, the officers found the car at the American Legion in Winter Haven. Hercules, Banks and their daughter had exited the car and a Diamondback 9mm semiautomatic pistol was found inside it.
Hercules was quickly apprehended on the side of the building and Banks was quickly detained. She immediately complied when the officers directed her to get to the ground and her actions were mimicked by her daughter.
“Please don’t kill us!” the child pleaded while lying on the ground. The officers detained her parents at gunpoint.
At no point was a weapon pointed at the child during the arrests, according to the Winter Haven Police Department. Both of her parents have been released along with her.
Perez declined to press charges. The State Attorney’s Office filed complaint affidavits for him for affray and Hercules for affray and improper display of a weapon.
