A criminal complaint charged Espinoza with being unlawfully present in the United States. If convicted, he faces a maximum penalty of two years in federal prison.

After being ordered removed from the U.S., Espinoza was actually removed from the country in 2022 and 2024. Authorities have yet to release details about how he returned to the country twice.

There is no record Espinoza ever applied for permission to return to the U.S. He never received permission to do so either.

Because of Espinoza’s acting Interpol red notice, the Department of Homeland Security Investigations (HSI) and the Federal Bureau of Investigation (FBI) conducted a targeted enforcement operation to arrest him. A surveillance team located him in Duval County, Florida, USA where he was arrested.

The arrest of the Honduran man was announced by Gregory W. Kehoe, who assumed office as the interim U.S. attorney for the middle district of Florida on March 31, 2025. As a prosecutor, the latter worked for the U.S. Department of Justice for more than two decades with postings in the U.S., Asia, Europe and South America.

Honduras is one of the seven countries in Central America, a subregion of North America. Xiomara Castro de Zelaya assumed office as the 39th president of the country on January 27, 2022 and turned 65 on September 30, 2024.
