J Alexander Kueng, 26, will rely upon the doctrines of self defense, reasonable use of force and authorized use of force at trial. The Nigerian-American former cop’s lawyer Thomas C. Plunkett filed his Rule 9 disclosure in district court in Minnesota, United States on June 29, 2020 at 12:28 p.m.

Involved in George Floyd’s lethal arrest, Kueng is charged with aiding and abetting an unintentional second-degree murder and aiding and abetting second degree manslaughter. Here is a copy of the former Minneapolis Police Department officer’s Rule 9 Disclosure:

DEFENDANT’S RULE 9  DISCLOSURE

TO: The State of Minnesota and the Prosecuting Attorney in the above-entitled case. Pursuant to Rule 9.02 of the Minnesota Rules of Criminal Procedure, Defendant makes the following disclosures:

I. I hereby inform you that the Defendant intends to rely upon the following defenses at trial:

  • Not Guilty
  • Self Defense
  • Reasonable Force (Minn. Stat. 609.066)
  • Authorized use of Force (Minn. Stat. 609.06)

II. Defendant presently intends to call the following witnesses at trial:As noted in the Complaint and attachments and as listed or mentioned in disclosures sent to the State and in particular: TBA

VIII. Defendant does not waive any rights to confrontation of witnesses, and unless otherwise stipulated, demands the appearance of all prosecution witnesses at trial.
