Zoey Felix of Topeka, Shawnee County, Kansas, United States has died. She was 5.
Felix is Ezequiel Felix Guerrero and Holly Jo Felix‘s daughter. While in a car, Holly Jo allegedly drove under the influence and committed aggravated battery.
Currently, Holly Jo is on probation for the charges. As conditions of the sentence in that case, she is prohibited from contacting the victims.
Holly Jo, Ezequiel and Zoey lived in a house on Market Street in Topeka with Zoey’s teenage sister and their family friend Mickel W. Cherry, 25, an off-grid person. On September 5, 2023, the Topeka Police Department was called for a welfare check at the residence following a report that it had no electricity.
On September 19, 2023, the department received two domestic disturbance calls in the residence within one hour. Still, Zoey and her teenage sister were not removed from the house.
Days later, Holly Jo allegedly kicked Ezequiel, their two daughters and Cherry out of the house. Zoey, her sister, Ezequiel and Cherry moved to a homeless camp in a grove of trees on a wooded lot near the gas station where Ezequiel worked.
On October 3, 2023, Cherry allegedly raped and killed Zoey at the homeless camp. At 5:55 p.m. that day, someone called 911 after finding Zoey, who was unresponsive, near the gas station.
Zoey was taken to the hospital where she was pronounced dead at 6:21 p.m. Later that evening, Cherry was arrested and jailed in Topeka.
On October 5, 2023, Cherry was charged with first-degree murder and rape. On October 12, 2023, he will appear in court.
Bond for Cherry was set at $2 million. He had no prior criminal record in Kansas but he has a misdemeanor criminal trespass conviction in Amarillo, Texas, USA.
