While serving as a confidential human source with the FBI, Smirnov reported in March 2017 to an FBI agent that he had had a phone call with the owner of Ukrainian industrial conglomerate Burisma Holdings, Limited about its interest in acquiring a U.S. company and making an initial public offering on a stock exchange based in the U.S. He reported that Hunter was a member of Burisma’s board.

In June 2020, Smirnov allegedly falsely claimed that during meetings in 2015 and 2016, executives associated with Burisma admitted to him that they had hired Hunter to protect them through his father “from all kinds of problems”. At the time, the then prosecutor general of Ukraine was conducting a criminal investigation into the company.

Smirnov allegedly made a false report claiming that Burisma paid Joe and Hunter $5 million each when Joe was still in office so that Hunter will “take care of all those issues through his dad” and to “deal with” the prosecutor general, who was fired in February 2016. In reality, Smirnov had contact with executives from Burisma in 2017 when Joe had no ability to influence U.S. policy.

In September 2023, FBI agents interviewed Smirnov. He allegedly repeated some of his false claims, changed some of his claims, claimed that he had met with Russian officials and promoted a new false narrative.

On February 14, 2024, Smirnov arrived in the U.S. from overseas and was arrested at the Harry Reid International Airport in Las Vegas, Nevada, USA. He was charged with making a false statement and creating a false and fictitious record.
