It was Washington County attorney Pete Orput who filed the complaint against the couple. Derek and Kellie were charged by summons in Washington County District Court in Stillwater, Minnesota with nine felony counts of aiding and abetting taxes, false or fraudulent returns or failing to file returns, the Minnesota Star Tribune reported.
“Our office has and will continue to file these charges when presented,” KIRO-TV quoted Orput as saying. “Whether you are a prosecutor or police officer or you are a doctor or a Realtor, no one is above the law.”
After working in Hennepin County Medical Center in Minneapolis, Minnesota, Kellie went to Kaplan University in Davenport, Iowa, USA for residential real estate and started working as a Realtor with Re/Max Results. Derek also worked as a real estate agent and club bouncer in his off hours while he was still employed as a Minneapolis Police Department officer.
As a security guard, Derek worked at El Nuevo Rodeo dance club, Cub Foods, Midtown Global Market and EME Antro Bar in Minnesota. As a police officer, he made between $52,000 and $72,000 from 2014 to 2019.
During those years, Derek and Kellie underreported $464,433 in joint income, owed $21,853 in taxes and owe a total of $37,678 if interest and late filing and fraud penalties are included, according to the complaint. If convicted, each of them will face up to five years in prison and up to a $10,000 fine.
In February 2005, Kellie was charged with writing a bad $42 check while she was living in Eau Claire, Wisconsin, USA. A criminal case was filed against her but it was dismissed because she eventually paid the amount, Daily Mail has learned.
Eventually, Kellie moved to Minnesota where she met Derek. They got married in 2010 but she separated from him on May 28, 2020, which was three days after the fatal arrest of George Floyd, and filed for divorce on May 31, 2020.
Days after Floyd’s death, the Minnesota Department of Revenue received information about Derek and Kellie and an investigation started. The department was informed that the couple did not report their incomes from their respective side jobs.
Upon learning of the investigation, Kellie tried to file for the missing years but she omitted extra income again. Washington Country assistant county attorney Scott Haldeman told WCCO, “It tells me that it was a willful act and there was intention behind not filing these returns.”
Held in jail on $1.25 million bail, Derek is currently detained in the Minnesota Correctional Facility, a maximum-security prison in Oak Park Heights, Minnesota. He is facing charges of second-degree murder, third-degree murder and second-degree manslaughter in connection to Floyd’s death.
