Philip Sarner biography: 13 things about Long Island, New York man


Philip Sarner and his girlfriend Emily Orbay stayed at the Quality Inn in Mystic, Connecticut, United States on June 26, 2020. That day, they attacked a clerk of that hotel named Crystal Caldwell, an African-American woman from Groton, Connecticut born in 1961.

  1. Neither he nor Orbay has a permanent address. Primarily, the couple resided in Nassau County on Long Island, New York, USA.
  2. He claimed that his depressive disorder and attention deficit disorder rendered him disabled beginning on October 30, 2002 but the Commissioner of Social Security denied in part his application for Childhood Disability Benefits and Social Security Income Benefits. He appealed the decision on May 22, 2012.
  3. On July 3, 2003, Dr. Judith Shaw concluded that he had borderline intellectual  functioning and his insight appeared to be fair to poor although his trend of thought was coherent.
  4. On May 21, 2004, he was hospitalized for cocaine, alcohol and marijuana abuse.
  5. From May 2004 to June 2006, his treatment notes from the Nassau County Corrections Center cited a diagnosis of cocaine abuse.
  6. On February 18, 2005, he was hospitalized at the Good Samaritan Hospital Medical Center in West Islip, New York for an overdose of pills.
  7. The Administrative Law Judge concluded that he was disabled as of March 1, 2005 but was not entitled to benefits for the period before that date having found that any disability he may have suffered prior to that date was not independent of his history of drug and alcohol abuse.
  8. On October 4, 2006, Dr. A. Nagra diagnosed him with a mood disorder and attention deficit disorder.
  9. On November 29, 2019, he was released on parole from Attica Correctional Facility after serving time for third-degree criminal possession of a controlled substance and first-degree criminal contempt.
  10. On July 1, 2020, arrest warrants were issued against him and Orbay. On the morning of July 13, 2020, the U.S. Marshals Service and the New York Police Department arrested him and Orbay in Brooklyn, New York. The two, who waived their right to an extradition hearing, were returned to Connecticut and arrived at the Stonington Police Department at approximately 9:15 p.m.
  11. He was 39 years old when he was arrested on July 13, 2020. He was charged with second-degree assault, third-degree assault and intimidation based on bigotry and bias while Orbay was charged with two counts of third-degree assault and intimidation based on bias. He was released on July 14, 2020 after posting a $75,000 bond. In August 2020, he was charged with second-degree harassment for allegedly making harassing phone calls to Caldwell’s attorney John Strafaci.
  12. When he and Orbay arrived at New London Superior Court in Connecticut for a hearing on April 28, 2021, they were met by protesters. He appeared to raise his hands and dance while she blew kisses to the protesters.
  13. He and Orbay are represented by Kevin Smith of Smith and Pattis, a criminal defense law firm based in New Haven, Connecticut. On July 19, 2021, Smith filed a civil lawsuit against Caldwell, her son Jamel Caldwell and Choice Hotels International Inc., which owns the Quality Inn. According to the lawsuit, he and Orbay are suing for more than $75,000 in damages, accusing Crystal of trafficking in personal identifying information and Jamel and the hotel of common law negligence and inflicting emotional distress. He and Orbay are scheduled to appear in New London Superior Court on October 28, 2021.
