2. Wearing a red cap, sunglasses and a gaiter, he went to the U.S. Capitol building in Washington, D.C. on January 6, 2021. That day, Donald Trump supporters breached the building while a joint session of Congress was certifying the vote of the Electoral College and affirming Joe Biden‘s victory in the 2020 presidential election. During the riot, he grabbed the arm of a law enforcement officer trying to stop his fellow rioters from entering the U.S. Capitol doors.
3. On January 4, 2021, he traveled via Southwest Airlines from El Paso to Washington, D.C., USA with two relatives. They stayed at the Capitol Hill Hotel in Washington, D.C.
4. On January 8, 2021, he and his two relatives returned to El Paso.
5. On March 23, 2022, Federal Bureau of Investigation special agents interviewed an individual who has known him and his sister since childhood. The individual positively identified him in a photo lineup.
6. A FBI special agent filed a criminal complaint against him, which was signed by U.S. Magistrate Judge Moxila A. Upadhyaya on October 24, 2022.
7. On October 26, 2022, FBI agents arrested him at a home in El Paso.
