4. He is 3 years older than Salinas native Cain Velasquez.
5. He lived at a home in San Martin that hosted Patty Family Child Care, a daycare business ran by his mother. More than 20 children attended the daycare establishment. In 2018, the daycare was written up twice for having inadequate number of supervisors for the amount of children present.
6. From 2021 to 2022, he allegedly inappropriately touched Velasquez’s son, then 4, on multiple occasions while the child was attending Patty Family Child Care.
7. In January 2022, he and Bender passed necessary criminal background checks and received child abuse index clearances or exemptions.
8. On February 23, 2022, the Sheriff’s Office Sexual Assault Investigation Unit (SAIU) detectives of the Santa Clara County Sheriff’s Office interviewed him and booked him into the Santa Clara County Main Jail in San Jose. His bail was set at $50,000.
9. On February 25, 2022, he was arraigned on a felony count of a lewd and lascivious act with a child under the age of 14. Over objections from the Santa Clara County District Attorney’s Office, a judge granted him supervised release and required him to wear an electronic monitoring bracelet. 
10. On February 28, 2022, his mother and Bender were with him in a Silverado while he was on his way to get his electronic monitoring bracelet. Driving a truck, Velasquez allegedly started following the Silverado at around 3:00 p.m. At around 3:25 p.m., Velasquez allegedly fired a .40 caliber gun at him seven times but hit Bender twice instead then rammed the Silverado. He and his mother were unharmed while Bender was taken to Regional Medical Center in San Jose with non-life-threatening injuries.
11. Represented by Stephen Defilippis, he pleaded not guilty to lewd and lascivious acts with a minor at a hearing in Morgan Hill, California on June 6, 2022.
12. On June 28, 2022, Velasquez’s wife, represented by Warren Paboojian, filed a civil lawsuit against him, Patty, Bender, Certified Custom Concrete and Patty Family Child Care.
13. The pre-trial for him on September 20, 2022 was granted a continuance. At a hearing in San Jose, Judge Cynthia A. Sevely approved a request to continue the matter until November 14, 2022 in order for a longer allowance of discussion time. He was 43 years old when Velasquez was granted $1 million bail on November 8, 2022.
