That day, Donald Trump supporters breached the building while a joint session of Congress was certifying the vote of the Electoral College and affirming Joe Biden‘s victory in the 2020 presidential election. During the riot, he was photographed next to Kyle Fitzsimons and caught on camera smiling as his fellow rioters assaulted Fanone.
In February 2023, Federal Bureau of Investigation special agents personally observed him.
On March 17, 2023, U.S. Magistrate Judge Zia M. Faruqui signed a criminal complained filed by an FBI special agent against him.

For his participation in the U.S. Capitol riot on January 6, 2021, he was charged with civil disorder, entering and remaining in a restricted building or grounds, engaging in physical violence in a restricted building or grounds, obstructing or impeding passage through or within the grounds of any of the U.S. Capitol buildings and engaging in an act of physical violence in the grounds of any of the U.S. Capitol buildings.
